: (1) Notwithstanding anything written in the existing law, no person with mental or psycho-social disability shall be kept in prison in the name of treatment or protection.
(2) Notwithstanding anything written in sub-section (1), there shall be no hindrance to keeping a person with a disability who is being prosecuted or sentenced for a criminal offense in prison in accordance with the prevailing law.
